Infraction Deferral Program

The Spencer County Prosecutor’s Office has an Infraction Deferral Program that may be available for individuals charged with traffic infractions (i.e. speeding tickets and other traffic tickets). Eligibility is at the complete discretion of the Spencer County Prosecutor and is determined on a case-by-case basis.  The prosecutor will determine if any additional terms should be included in the infraction deferral agreement.

If eligible, the traffic offender must enter into a written agreement with the Spencer County Prosecuting Attorney and pay a non-refundable fee of $212.50.

This program allows you to defer your ticket for eight (8) months at which time it will be dismissed pursuant to IC 34-28-5-1 if you have not committed any further moving violations or criminal offenses and it will not appear on your driving record.  However, if you violate any term of the deferral agreement, your case will be returned to the Court’s docket for further prosecution.

Upon processing (allow 4 weeks for processing) of your citation, Pre-Trial Deferral paperwork will automatically be sent to the address listed on your ticket on the following conditions:

  • You do not have a CDL license.
  • You have a valid driver’s license.
  • The address on your driver’s license is current.
  • You are not currently on a deferral program.
  • You have not been on a deferral program in Spencer County in the last 12 months.
  • You are not more than 30 mph over the speed limit.
  • You have not received your ticket due to an accident, issued in a school or construction zone, or failure to yield to an emergency vehicle.
