Discipline charges filed against Marion County Judge Gaither
The Indiana Commission on Judicial Qualifications has filed disciplinary charges against Marion County Superior Court 9 Judge Geoffrey A. Gaither. The commission alleges Judge Gaither failed to properly act in a number of cases and failed to adequately supervise court staff. Judge Gaither is permitted (but not required) to file an answer to the charges within 20 days.
The “Notice of the Institution of Formal Proceedings and Statement of Charges” (Case No. 26S-JD-311) is public record and has been filed with the Appellate Clerk’s Office. The charges are brought by the seven-member commission, which investigates alleged ethical misconduct by judges.
The commission charges three counts of misconduct. The commission alleges Judge Gaither violated the Code of Judicial Conduct by failing to promptly set motions for hearing or to rule on motions following a hearing, leading to the removal of cases from the judge; by failing to adequately supervise a magistrate under his authority, resulting in case delays; and by failing to adequately supervise court staff, leading to cases being dismissed, delays in cases being resolved, and incorrect case entries.
The Supreme Court has final authority to determine what, if any, judicial misconduct occurred. The Court can dismiss the charges, accept or reject a disciplinary agreement between the commission and Judge Gaither, appoint a panel of judges to conduct a public hearing, impose a fine, or impose sanctions ranging from a reprimand to a suspension to a permanent ban on holding judicial office in Indiana.
