Press release: Court of Appeals Vacancy

For Immediate Release | March 5, 2024

Applications available for Court of Appeals of Indiana

Chief Justice Loretta Rush announced today that the Indiana Judicial Nominating Commission will begin accepting applications for a vacancy on the Court of Appeals. The position on the state's second highest court will become available when Judge Patricia Riley, representing the fourth appellate district, retires this summer.

Chief Justice Rush, who chairs the Commission, and Court of Appeals Chief Judge Robert Altice, Jr. encourage eligible Indiana judges and lawyers to consider applying. Applications are due by June 7 at noon (Eastern).

The judge for this vacancy will represent the fourth appellate district. The fourth district is statewide and consists of a judge from each of the three appellate districts. This vacancy is for the northern third of Indiana – district three. That means, candidates must be an Indiana resident living in the third appellate district. Candidates must also be a member of the Indiana Bar for at least ten years or have served as an Indiana judge for five years. Candidates must provide pertinent background information, writing samples, references, and educational transcripts.

The Commission will consider the applications and letters of recommendation and then will conduct public interviews of qualified candidates. Interviews are expected to be conducted June 24-25 and July 22-23. After deliberating in executive session, the Commission will publicly vote to send the three most qualified names to Governor Eric Holcomb. The Governor will have 60 days to select Indiana's next Court of Appeals judge from the three names submitted by the Commission.

Chief Justice Rush (as chair) and the seven-member Commission includes three lawyers elected by their peers and three citizen members appointed by the Governor. Details on the Commission, including membership, are online. Those interested in applying may contact Commission Staff Attorney Larry Newman at Larry.Newman@courts.in.gov.
