Pre-trial Supervision

Indiana Code 35-31-2-121.5 and Criminal Rule 26 govern pretrial release in Indiana. The rule states that arrestees who don't pose a significant risk of flight or danger should be released without bail. Shelby County Probation does pre-trial assessments and makes recommendation on release for newly arrested individuals. The Court will utilize the pre-trial assessment reports for making decisions on pre-trial release.

Shelby County pre-trial release supervision includes basic supervision, moderate supervision, and enhanced supervision with home detention. All participants of pre-trial release must follow pre-trial supervision rules.
