Introduction
It is not an easy thing to calculate the time that an offender must serve. In its simplest form, you are given a Credit Class that matches the sentence, a start date, and the number of days that an offender must serve. But there is often more information to consider.
But what if the current sentence is affected by previous time served? What if the offender has served time under many different Credit Classes?
The Sentencing Calculator and the Simple Date Calculator are designed to solve these problems.
Sentencing Calculator
The Sentencing Calculator is designed to help you determine the time that an offender must serve based on current sentencing information and previous time served/credited.
- First, enter the "Time To Serve" information. This will calculate the current sentence without any adjustments.
- If the offender has served time in the past, you will use the "Previous Time Served" fields to enter the information on previous time served. When you have entered the start time and end time or the number of days, as well as the credit class, hit the "Add" button to apply the information to the current calculation.
- Repeat this last step for each instance of "Previous Time" that the offender has served.
- If you make a mistake you can hit the "X" to remove a "Previous Time" entry, or hit "Reset" to start over.
- To display a summary for Print, hit the "Print" button.
Simple Date Calculator
Sometimes you just need to know the number of days between two dates or the end date after a start date and a number of days. Simple Date Calculator is designed for this purpose.
To get the number of days:
- Enter the start and end dates. The calculator will give you the number of days from one day to the other, including the start date.
To get the end date:
- Enter the start and the number of days. The calculator will find the end date based on the current start and the number of days including the day selected as the start day.
Credit Classifications
According to IC 35-50-6-3.1 and IC 35-50-6-4:
Credit Class A:
- A person (1) who is not a credit restricted felon; and (2) who is imprisoned for a Level 6 felony or a misdemeanor or imprisoned awaiting trial or sentencing for a Level 6 felony or misdemeanor.
- Serve 1 actual day; earn 1 credit day.
Credit Class B:
- A person (1) who is not a credit restricted felon; and (2) who is imprisoned for a crime other than a Level 6 felony or misdemeanor (i.e. Murder, Levels 1-5) or imprisoned awaiting trial or sentencing for a crime other than a Level 6 felony or misdemeanor (i.e. Murder, Levels 1-5).
- Serve 3 actual days; earn 1 credit day.
Credit Class C:
- A person (1) who is a credit restricted felon (see IC 35-31.5-2-72); and (2) who is imprisoned for a crime or imprisoned awaiting trial or sentencing.
- Serve 6 actual days; earn 1 credit day.
Credit Class D:
- Disciplinary level that may be imposed for violations of (1) a rule of the Department of Correction; (2) a rule of the penal facility in which the person is imprisoned; (3) a rule or condition of a community transition program.
- Serve 1 actual day; earn 0 credit days.
