Subject Matter of Rule

SEA 386 was enacted in the 2021 Indiana General Assembly legislative session, creating Indiana Code chapter 8-1-40.5 and establishing a pilot program for securitization of retired electric utility assets. At this point in time, the pilot program only applies to Southern Indiana Gas & Electric Company, also known as CenterPoint Energy Indiana South (“CenterPoint”). The statute, specifically Ind. Code ยง 8-1-40.5-19, requires the Commission to adopt a rule regarding this securitization program and allows for the rule to be adopted using emergency rulemaking procedures and not expire until a superseding rule is adopted by the normal rulemaking procedures.

Following two public comment periods, the Commission adopted an emergency rule on Dec. 15, 2021, that was effective Jan. 1, 2022. Documents and comments relating to this rule can be found at the links below. Pursuant to HEA 1623 enacted in 2023, this emergency rule was placed on the Governor’s list and will expire on Oct. 1, 2024.
