Application for Licensure
An entity is not required to hold a license as an administrator in this state if the entity exclusively provides services to one or more bona fide employee benefit plans each of which is established by an employer or an employee organization, or both, and for which the insurance laws of this state are preempted pursuant to the Employee Retirement Income Security Act of 1974, 29 U.S.C. ยง 1001 et seq.
An administrator is not required to hold a license as an administrator in this state if all the following conditions are met:
a. The administrator has its principle place of business in another state;
b. The administrator is not soliciting business as an administrator in this state; and
c. The administrator's function in Indiana is limited to the administration of life, health, or annuity coverage for a total of not more than one hundred (100) Indiana residents.
Does the applicant hold a valid resident or designated home state administrator license in one of the following states? If so, then administrator can apply for a non-resident insurance administrator license in accordance with IC 27-1-25-12.2. If the administrator holds a non-resident license in one of the asterisk states administrator can apply for a non-resident license in Indiana as the requirements in these states are the same for resident and non-resident.
If the insurance administrator doesn't meet the above then administrator must apply for a designated home state license in accordance with IC 27-1-25-11.1. Insurance administrator applying for a designated home state license is held to the same standards as a resident insurance administrator.
