This rule repeal aligns the provisions of 465 IAC 3 with Indiana Code given the

recently passed legislation HEA 1466 (2025) taking effect July 1, 2025. Pursuant to Indiana Code, the Department of Child Services (Department) is currently required to have administrative review processes aligned with IC 4-21.5-3. The current articles of 465 IAC 3 reflect the requirements across all applicable statutes and areas of agency action wherein an internal agency administrative review process (prior to an administrative appeal) is contemplated and made available to the public and various business entities. Areas of such application include: substantiated reports of child neglect in relation to child care workers and licensed foster parents; similar reports as to department employees; exceptions to review of abuse or neglect determinations based on court findings; and, appointment of

Administrative Law Judges to conduct reviews and schedule hearings for matters subject to review.
