[R57] Legislation helping children with disabilities signed into law

STATEHOUSE — Legislation sponsored by State Representative Sean Eberhart (R-Shelbyville) to help provide for children who have serious disabilities was signed into law by Governor Pence. 

Senate Enrolled Act (SEA) 397 requires the Office of Medicaid Policy and Planning to reimburse for a specialized or nonstandard wheelchair for a child recipient who resides in a nursing facility. Currently, if a child is unable to be rehabilitated, they do not qualify for reimbursement. 

“Many of the children living in these facilities will never be rehabilitated. For them, the smallest movements will be some of their biggest accomplishments,” said Rep. Eberhart. “As a father, it is difficult for me to believe that their inability to be rehabilitated is what prevents them from getting replacement wheelchairs from Medicaid. This new law will help them obtain the specialized equipment that they need for daily living, and quite frankly deserve.” 

Indiana is home to just three nursing home facilities that serve the needs of children with severe disabilities. Especially Kidz, located in Shelbyville, is one of them. 

“While we celebrate the signing of this legislation and all that it will do for Hoosier children, it is important that we also recognize the men and women who work in these facilities across Indiana and bring care and joy to the lives of these children every day. I particularly want to thank everyone at Especially Kidz and assure them that their work does not go unnoticed. Our community appreciates them, and I do as well.”

SEA 397 will go into effect on July 1, 2014.
